Family law is probably the most emotionally charged area of law imaginable. Issues are often dealt with on a financial playing field even though much of the problem may be rooted in hurt feelings. And often people feel the best way to get even is through the wallet. It is important for your lawyer to keep this in mind in order to ensure that you receive the best advise and assistance possible in addition to lending an ear for some of those more troubling days that will no doubt arise.

The issues present in family law may often seem simple at first glance, and certainly with cooperation between the parties there is no reason for the issues to be otherwise, personal dynamics between the parties can create whirlwind problems for each other.

Generally, upon separation and divorce, the major issues revolve around the grounds for separation, custody and access to children, support of spouses and the children, and division of property. Some of the more common questions surrounding separation and divorce are: who is entitled to access or custody? When are you legally separated? Under what circumstances can a man get custody of the children? Who gets to stay in the matrimonial home? How much support is the custodial parent entitled to? Can one party sue the other for misconduct? What is the effect of adultery? If the wife works, can she get spousal support? What if the marriage was less than a year, what is the rule for dividing property? How long does it take to get divorced? What is mediation and arbitration and will it work for your case? What if we are not married, are there any differences in the laws? All of these questions are important in dealing with your case and which need to be answered with you in mind.

The answer for you may be different than the answer would be for everyone else because no two cases are identical. You, as our client, have specific and individual needs that will have to be accommodated in order to suit you. So while many information packages will provide you facts and statements of laws and legislation, they may not be able to provide you with all of the exceptions to those laws and rules. We, however, may be able to do just that. We often find that many of the rules do not specifically apply to our clients, and, in fact, many of the rules and regulations therefore need to be changed or amended to suit our clients needs. This results in what is called "judge made law". This is the basis that most law is interpreted by courts. The courts are faced with the rules, regulations and laws and must apply them. It is the "application" that becomes important in your case and in cases that are decided in the future.

Other family related services include estate planning, preparation of wills and dealing with both contested and uncontested estates matters as well as providing marriage contracts or cohabitation agreements.
